Mercator International prepared a report and provided expert testimony for a London Court of International Arbitration (LCIA) proceeding addressing a concession dispute in Africa. Topics evaluated included the terms of the disputed concession (as compared to other concessions in the region and worldwide), pricing of services, and terminal operator performance. In addition to making qualitative comparisons of various aspects of the disputed concession agreement against typical provisions of other such agreements, Mercator prepared a quantitative analysis of fees paid in respect of more than 50 different reference agreements. The analysis was presented to the court to provide a factual basis for assessing the reasonableness of the fees in dispute.
